Terms of service
The agreement between you and OrbitFx. The trading rules your account is scored against are a separate, versioned document — this covers everything around them.

These terms describe how the platform operates today and are published so beta testers know what they are agreeing to. They have not been reviewed by counsel; the governing law, contracting entity and dispute-resolution clauses are not yet settled. A reviewed version will replace this before any account is sold.
1. What the service is
OrbitFx provides simulated trading accounts for the purpose of evaluating trading ability. You trade a simulated balance against prices derived from real market data. No order you place reaches an exchange, no financial instrument is bought or sold on your behalf, and OrbitFx does not hold, receive or transmit client funds.
Nothing on this platform is investment advice, a recommendation, or an offer to deal in financial instruments. Simulated results do not indicate what would have happened in a live market and do not predict future performance.
2. Eligibility
You must be of legal age in your jurisdiction and legally permitted to use a service of this kind. You are responsible for determining whether your use is lawful where you live. We may decline or close an account where we believe use is prohibited, and access from certain jurisdictions may be restricted.
3. Your account
You are responsible for your credentials, including any API keys you issue. A key acts as you; treat it as you would a password and revoke it from your dashboard if it may be exposed. Accounts are personal — do not share access, and do not create multiple accounts to obtain more attempts than the rules allow.
4. The trading rules
Each account is evaluated under a specific, versioned rule set that is published in full before the account is created and pinned to it permanently. Later changes to our published rules never apply retroactively to an existing account. The rule set governing your account is linked from the account itself, and the current offering is always at the rules page.
A breach of those rules ends the evaluation. The account becomes read-only, and the decision is recorded with the tick and price that produced it.
5. Execution
Orders are filled against the OrbitFx index — a median across multiple venues — after a deliberate execution delay drawn from a published band, applied uniformly to every account. Fills include modelled spread, market impact and fees, and open positions are charged funding at rates settled by the reference venues.
Where the platform cannot be confident in the index — venues disagreeing beyond tolerance, or feeds going stale — trading is halted until confidence is restored. Halts may occur without notice and are not a breach of these terms.
6. Conduct that is not permitted
The evaluation measures trading ability. The following attack the structure of the evaluation rather than the market, and may result in an account being closed without a pass:
- Running one strategy or signal across multiple accounts, whether your own or in coordination with others.
- Holding offsetting positions across accounts so that one is guaranteed to pass regardless of skill.
- Exploiting a defect in the platform — a pricing error, a stale quote, a bug in order handling — rather than reporting it.
- Attempting to interfere with the index, the platform's infrastructure, or other users' accounts.
- Misrepresenting your identity, or using the service where it is prohibited for you.
Automated and algorithmic trading through our API is expressly permitted and is not covered by the above.
7. Fees, funded accounts and payouts
During the closed beta, accounts are provided free of charge and no payouts are made. When paid challenges open, the fee, the funded account terms and the profit split will be published before purchase and will apply as published to accounts created under them.
8. Disputes about a fill or a breach
Every account carries an evidence pack that re-derives its fills from stored orders, recorded index history and the versioned execution configuration. You may generate it yourself at any time without asking us.
If the re-derivation disagrees with what was applied to your account, tell us: that is our error and we will correct the outcome. Because the underlying records are append-only, neither you nor we can alter the evidence after the fact.
9. Availability
We aim to keep the platform running continuously but do not guarantee uninterrupted availability. Maintenance, provider outages, and index halts can interrupt trading. Where an interruption materially affects an evaluation, we will act to put the trader in the position they would otherwise have been in.
10. Liability
The service is provided as-is. To the extent permitted by law, OrbitFx is not liable for indirect or consequential loss, or for loss arising from your reliance on simulated results. Nothing in these terms limits liability that cannot lawfully be limited, including for fraud. The specific limits applicable to you will be stated in the reviewed version of these terms.
11. Termination
You may close your account at any time. We may suspend or close an account for a breach of these terms, for conduct listed in section 6, or where we are required to. Where we close an account for cause, the reason is recorded and given to you.
12. Changes to these terms
We may update these terms, and will publish the date of the change at the top of this page. Material changes will be notified to registered users. Changes to these terms never alter the trading rule set an existing account was created under — that guarantee is in section 4 and is deliberate.
13. Governing law
The governing law and the contracting entity are being settled with counsel and will be stated here in the reviewed version. Until then no representation is made as to jurisdiction.
